Welcome to BachataGrow. These Terms of Service (“Terms”) govern your access to and use of the BachataGrow website, apps, and services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 13 years old to use BachataGrow (or the minimum age required in your country, if higher). You must have the legal capacity to enter into these Terms. If you use the Service on behalf of a studio or organization, you represent that you are authorized to bind that entity to these Terms.
2. Your account
You create an account by signing in with Google. You are responsible for maintaining the security of your account and for all activity under it. Notify us immediately at [email protected] if you believe your account has been compromised.
3. Your content
You retain ownership of the videos, moves, combos, class notes, comments, and other content you submit to BachataGrow (“Your Content”). By submitting Your Content, you grant BachataGrow a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to generate thumbnails or transcode video), and display Your Content solely to operate and improve the Service for you and the audiences you choose (e.g. students enrolled in your class).
You represent and warrant that you have all rights necessary to submit Your Content and that Your Content does not infringe any third party’s rights.
4. Acceptable use
You agree not to:
- Upload content that is unlawful, infringing, defamatory, hateful, harassing, or sexually explicit.
- Use the Service to impersonate any person, misrepresent affiliation, or spam other users.
- Attempt to probe, scan, reverse engineer, or circumvent the security of the Service.
- Scrape, copy, or redistribute content from the Service without permission.
- Use the Service to train machine learning models on other users’ content.
5. Payments & refunds
Some parts of the Service are paid (e.g. private lesson credits, teacher subscriptions). Payments are processed by Stripe. You agree to the pricing shown at checkout. Unless a specific refund policy applies, purchases are non-refundable, but you may cancel any recurring subscription at any time and it will not renew.
Private lesson cancellations are governed by the teacher’s cancellation policy shown at the time of booking. Where a lesson is canceled in accordance with that policy, the credit used is refunded to your BachataGrow credit balance.
6. Calendar invites and transactional email
When a class or private lesson is scheduled or updated, we send transactional emails to affected parties with an “Add to Google Calendar” link and an .ics attachment so that you can add the event to whichever calendar app you use. Adding the event is your choice; we do not access or modify your calendar directly.
7. Termination
You may stop using the Service at any time and delete your account from account settings or by emailing [email protected]. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the Service to you becomes commercially unreasonable.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BACHATAGROW AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.
10. Indemnification
You agree to indemnify and hold BachataGrow harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from Your Content, your violation of these Terms, or your violation of any law or third-party right.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws provisions. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
